Kotkhai case: CBI says has nailed accused, June 27 next hearing

Shimla, May 30: The CBI on Tuesday submitted a fresh status report in the infamous Gudiya rape and murder case and a copy of the chargesheet against accused Anil Kumar, alias Nilu, in the Himachal Pradesh High Court. The chargesheet was later filed in the trial court.

The 28-page chargesheet, containing statements of about 60 witnesses, said it had sufficient evidence against the accused. The High Court has fixed June 27 as the next day of hearing.

As per the chargesheet, the accused raped the girl alone and murdered her on July 4, 2017, the day the minor had gone missing. Her body was found in Halaila forests in Kotkhai on July 6.

The investigation revealed that a scuffle took place between the accused and the girl after the former spat at the latter.

The chargesheet also mentioned that the SIT constituted by the Himachal Police had claimed on July 13 that five persons had been arrested on the basis of scientific and circumstantial evidence.

The case was referred to the CBI on July 19. The agency found that the five persons — Rajendra Singh, Lokjan, Subhash, Deepak and Suraj — were not guilty. It also found that one Ashish Chauhan arrested earlier was also not involved. The agency has recommended that all of them be discharged under Section 169 of the CrPC.

As Suraj had died in police custody, nine police personnel, including Inspector General ZH Zaidi, then Shimla SP DW Negi and DSP Manoj Joshi, were arrested. They are still in judicial custody and the CBI has already filed a chargesheet against them. The CBI arrested woodcutter Anil Kumar, alias Nilu, on the night of April 13, 2018. The swab sample of a bite on the breast of the victim helped the CBI match the DNA of the accused. The DNA sample collected from the bottle of country liquor further established the identity of the accused.
